The purpose of the Terms and Conditions stated below is to regulate the relationship between LAMARENCALMA IBERIA, S.L. and the customers or users of its website or e-commerce portal.
LAMARENCALMA IBERIA, S.L is a commercial company, NIF ES B95718375, registered in the “Mercantile Register of Bilbao in Volume 5365, page 115,registration 1, sheet BI-62152, whose purpose is to sell nautical and electronic products in general, through its web site www.lamarencalma.com.
LAMARENCALMA IBERIA, S.L is registered in the “Registro de Empresas de Venta a Distancia del Ministerio de Industria, Turismo y Comercio con el número NEVA 2011/0329/09/08/9/V de conformidad con el Real Decreto 1976/1998 de 18 de Septiembre y Real Decreto 1133/1997 de 11 de Julio.”
The terms and conditions stated here will regulate the acceptance of the services contracted between LAMARENCALMA IBERIA, S.L. and its customers and users in its website. It will become the contract of sale accepted by both sides from the moment of the buying process acceptance.
The present conditions are subject to the current “Leyes del Comercio y Defensa de los Consumidores vigentes” and will be adapted to future Laws and Norms.
The information in www.lamarencalma.com or in www.lamarencalma.es is protected by the rights and registries of the proprietary brands of their logos, photographs and commercial information offered. Its commercial use is not allowed nor its private use without the expressly written authorization by the owner of the brand.
In order to execute the order, the customer will have to provide his personal data needed to fulfill the order. He will be the only responsible of the truthfulness of this data.
The features of the products are given by the manufacturer or the importer, and its image is for guidance, without limitations of the described features.
Orders and prices
The orders will include the prices published in the web when such order was made. The prices billed to the customer will be those that appear in the web in the moment of the purchase, unless there are typographical errors that will be informed to the customer before fulfilling the order.
If the customer requires products that don’t appear in the web of lamarencalma.com, they will be budgeted and billed according to a price stipulated by LAMARENCALMA SHOP, S.L.
The prices include the corresponding Value Added Tax (VAT) and do not include the shipment expenses, installation, etc.
The acceptance of the order will include the desired transportation costs. The purchase contract will finish with the final acceptance of the order by the customer and when the payment of the total amount of the order has been paid by the customer to LAMARENCALMA IBERIA, S.L. In the case of second deliveries due to wrong or incomplete addresses or absence of the addressee, the customer compromises to pay all the additional costs that this might involve.
LAMARENCALMA IBERIA, S.L reserves the right to change the prices, without retroactive value to the orders made.
Deposits made to serve products requested on demand, will not be returned to the customer in the case of cancellation of the order by the customer.
LAMARENCALMA IBERIA, S.L has the following payment methods available for its customers, Bank transfer or Payment on account, Credit card, Cash on delivery, Bank money order & Pay Pal.
1.- Bank transfer or Payment on account (before the shipment)
After fulfilling your order, you will receive an e-mail with the account number where the bank transfer or payment must be done. If you select this option, you must send us the receipt by fax to the number 902 090 064.

2.- Credit Card
The allowed credit cards are: VISA, VISA ELECTRON, 4B, TARJETA 6000, MASTERCARD, MAESTRO and AMERICAN EXPRESS.
3.- Cash on delivery
This payment method is only allowed for orders up to 1.000 euros in the Iberian Peninsula and Balearic Islands.
There is an additional commission of the special delivery company of 3,5% of the order in the Iberian Peninsula and Balearic Islands with a minimum cost of 3€.
4.- Bank money order (direct debit in your bank account)
Bank money order can only be used by those that are registered as companies or autonomous (self-employees); and only for amounts greater than 500 €. You will have to let us know that you want to use this payment method when you are your submitting your order. In this case, your order will have to be accepted by the Administration department of LAMARENCALMA IBERIA, S.L.
PayPal allows sending payments in Internet to those customers that have e-mail in a safe, comfortable and profitable way. There will be an additional commission in this service of 3,5% of the order.
1.- Postal delivery (Traditional service)
The approximate delivery time to Peninsula and Balearic Islands is from 1 to 8 working days and about 12 working days to Canary Islands, Ceuta and Melilla since the exit date from our warehouses.
If the package hasn’t been correctly delivered within 20 days by the Post Office, we will start a claim so that delivery takes place as soon as possible. You will need to notify us about this delay from the Post Office.
Please notice: if you chose this delivery method, it is mandatory that the delivery address is as accurate as possible. If the Post Office considers that the delivery address is not valid, they will return the package to the sender without any chance for a new delivery. This will extend the delivery deadline and will double the transportation costs as a new delivery needs to be made.
If the addressee is not available in the delivery by the postman, the postman will leave a warning note so that starting the next day and during 9 days, the customer can collect the package in the Post Office detailed in the warning note.
2.- Special delivery (less economic but faster)
The approximate delivery time to Peninsula and Balearic Islands is from 1 to 3 working days since the exit date from our warehouses.
The delivery to Canary Islands takes about 4 working days by air mail and 10 working days by sea mail. In the case of Ceuta and Melilla this timeframe varies between 7 and 10 working days.
Lamarencalma.com obliges itself to deliver the purchase made by the customer in the buyer’s address, as indicated in the order form. It will always be to a particular address, and never to Post Office Boxes.
The customer must indicate the carrier any visible loss or damage in the moment of the delivery, in the packing slip. The customer must also immediately communicate it to LAMARENCALMA IBERIA, S.L. to start the claim procedure to the carrier. After 24 hours from the delivery, it will not be possible to make any claims regarding the sending and delivery conditions.
The delivery timeframe is always subject to the selected payment method, the sending will always be posterior to the payment collection. LAMARENCALMA IBERIA, S.L. will try to make the delivery in the minimum possible time. In the case of non availability of one product during a time frame superior to 20 days, the customer can request the cancellation of the purchase of that product, and he will be refunded without constituting compensation for both parties.
The customer has 7 working days to exercise the right of dismissal, that is, to communicate the intention of returning the product.
The return of non wanted products after their reception can be done in no more than 14 working days from the date of the exercise of the right of dismissal. The returned products have to be in perfect state, with the original packaging and labeling and in the same box in which it was sent. They must have all the corresponding additions and /or accessories. The transportation expenses will be charged to the buyer, the buyer will be able to change it by another product or get the refund of the price in the moment of the delivery.
In order to execute this option, the customer must contact LAMARENCALMA IBERIA, S.L, by telephone +034 946064207 or e-mail email@example.com, indicating his data and the product to refund. LAMARENCALMA IBERIA, S.L will authorize the return assigning the customer an acceptance number.
Software or DVDs refunds are not allowed if they have been unsealed. They will only be substituted in the case of malfunction by others in good working conditions.
Returns of products ordered on demand are not accepted.
LAMARENCALMA IBERIA, S.L. responds to the lacks of conformity which manifest within two years from the delivery. The customer must inform us of the lack of conformity within two months after he has knowledge of it.
The products are covered by the guarantees of the manufacturer or importer, who will attend the claims, although sometimes these have to be managed through the seller. For this purpose, the billing receipt must be provided, with a clear indication of the serial number, if applicable, and the purchasing date. The first action will be to contact LAMARENCALMA IBERIA, S.L, so that we can show you how to proceed.
According to the law, the guarantees do not accept products in bad state, abuse or manipulation that hasn’t been made by the manufacturer or a service designated by him.

In order to get a proper provision of services offered by LAMARENCALMA IBERIA, S.L, the user must answer each and every question in the forms on our website.
We will ask only for those data necessary to provide the service required and they will only be used for this purpose. LAMARENCALMA IBERIA, S.L. ensures confidentiality of data and guarantees that, under no circumstances will they be transferred for any other use without explicit prior consent of our customers.
The user declares, in the event of providing personal data of third parties, to have their explicit consent informing these third parties, about the content of the data provided, their origin, their existence and the purpose of the file which contains their data, of the possibility of exercising rights of access, to oblivion, to the limitation of treatment, portability, rectification, cancellation and opposition as well as information identifying LAMARENCALMA IBERIA, S.L.
The purpose of this file is to maintain the contractual relationship with our customers, facilitating the processing of orders, statistical analysis, and in the case that we have been expressly authorized in the appropriate box, also to send communications about products and services marketed by LAMARENCALMA IBERIA, S.L that may be of your interest.
Customers of LAMARENCALMA IBERIA, S.L may at any time exercise their rights of access, rectification, cancellation and opposition by e-mail to firstname.lastname@example.org or directly on our website www.lamarencalma.com or in writing to our offices in Bilbao.
After a period of thirty days from the acceptance of these conditions without receiving an explicit negative from your side, to the use of your data for commercial communications through electronic processes, we understand that you consent to such treatment, without prejudice to your right to revoke it at any time by written communication to LAMARENCALMA IBERIA, S.L
Law and Jurisdiction
These General Terms are ruled by the Spanish Law. As a prerequisite to the start of litigation, LAMARENCALMA IBERIA, S.L and the customer are obliged to negotiate in good faith to resolve the dispute or controversy over the term of one (1) month from the date on which either party gives written notice to the other about his aim of a potentially disputed claim.
